Who is to blame?
Often cases involving pedestrians may involve an element of contributory negligence on behalf of the pedestrian who has stepped out into the road. However the extent of contributory negligence, if any, will depend upon the particular circumstances of the road traffic accident.
Road users' duty of care
Drivers have a duty to take reasonable care to avoid causing damage or injury to others using the road. Drivers must, under the Highway Code, adjust their driving to the circumstances they find themselves in, taking into account weather, road conditions, weight of traffic and likelihood of pedestrians or children crossing the road. Generally, cases of negligence are pursued but there are circumstances where a driver may breach a particular statute, for example where a pedestrian is knocked down whilst using a designated pedestrian crossing, as the traffic laws are designed to protect pedestrians.
