Girl is awarded £2m compensation for oxygen starvation at birth

A girl of three has won compensation worth £2m at the high court after being starved of oxygen at birth.

Sever cerebral palsy

Born at the Chesterfield Royal Hospital Amy Nunes-Mayo in August 2003 has the severest form of cerebral palsy.

Delivery negligently mismanaged

Chesterfield Royal Hospital NHS Foundation Trust admitted her delivery had been negligently mismanaged, they have agreed to make annual payments of £250,000 a year to cover the costs of Amy's care.

The award will cover Amy's needs for the next nine years; if she lives to see her 12th birthday she will be eligible to seek further compensation.

Her parents Iona and Neil said:

"We remain deeply saddened by what happened to Amy at the time of her birth. It has had a devastating impact upon all our lives. We are relieved that the claim has been settled and that we can now provide for Amy's needs for the future.

We hope that other families with children like Amy may benefit from settlements of the sort we have been able to achieve in Amy's case."

In a statement the trust said it "accepted full responsibility for the injuries arising from the circumstances of Amy's birth and has expressed its unreserved apologies to her family.

Since then the trust and the family have worked together to agree a flexible approach to provide for Amy's needs now and into the future.

The trust would also like to pay tribute to the dedication and devotion of Amy's parents towards her care and welfare."
