Legal action following baby death at Worcestershire Royal Hospital

09/11/2004

May I thank you for the way my accident claim has been handled, after my accident my confidence was very low indeed but the sympathetic handling of my case restored my confidence.

John, Sheffield

A woman has approached clinical negligence experts Alexander Harris to take legal action against Worcestershire Royal Hospital after the death of her newborn boy.

Louise Hunt, Partner at Alexander Harris is investigating Mrs Jones case.

Nadia Jones claims Harry was starved of oxygen because hospital staff failed to carry out routine checks. He died seven hours after being born in September.

Mrs Jones, from Kidderminster, is calling for the midwives who treated her to be sacked.

The health trust concerned has expressed its sympathies, but said the "appropriate" care was given.

The care given to Mrs Jones was appropriate and within national guidelines

Mrs Jones said the failure to treat her properly started when she did not go into labour after her waters broke on 11 September.

Mrs Jones and her husband Steven said midwives failed to carry out routine checks and sent her away with antibiotics, a course of action the couple say was repeated the next day.

The Joneses said it was only when they returned to the hospital for a third time that a midwife realised there was a problem.

In a statement, Worcester Acute Hospital NHS Trust said: "We have enormous sympathy with the family on the loss of their baby and we have met with them on several occasions in an effort to keep them fully informed of the investigation.

"The care given to Mrs Jones was appropriate and within national guidelines.

"However, we would normally have offered the parents some choices around intervention, which in this case this did not happen.

"It is not possible to say if the parents had been given all of the options available whether the outcome would have been different.

"We would like to reiterate our sincere apologies to the family."
