Acting as Receiver - controlling the patient's monies
I would like to thank you again for the speedy and sensitive way in which you have dealt with this matter. I would have no hesitation in recommending your firm to anyone in the future.
Pamela, Castleford
Don approached the private client solicitor Emma Gaudern to ask her to act as his receiver. Although at the time she was appointed as receiver, Don was making a claim in relation to an injury he had suffered, no compensation had yet been received and Don was living off his benefits. Because Don had suffered a head injury, he didn't always realise the consequences of drawing money out of the bank. He generally spent all his benefits as soon as he collected them, and frequently ran up to his overdraft limit.
When Emma was appointed as receiver, she and Don worked out a weekly budget of how much money he needed. She arranged for all his benefits to be paid into her receivership bank account, and transferred only enough money to Don to meet his spending needs. She organised payments to clear Don's overdraft and to get him out of debt. Don now manages his money much better and is completely out of debt. Emma organised for his overdraft facility to be reduced, so there is no chance for him to run into financial trouble again.
