Seven-Figure Compensation For Man Paralysed In Work Injury
A man who was left paralysed after being struck by falling boxes whilst at work has received a compensation settlement worth in excess of £5m.
Our client, Mr Pullen, suffered severe spinal injuries after being pinned to the ground by falling boxes whilst at work in July 2005, causing him to be paralysed from the waist down and leaving him with very little movement in his hands.
Mr Pullen approached Irwin Mitchell to make a compensation claim and, due to the nature of his injuries and his immediate need for specialist care, work accident solicitors sought to secure a series of interim payments throughout the case. These payments eventually totalled some £820,000 and helped Mr Pullen to fund the 24/7 care that he required at his chosen nursing home. His case manager was also able to put an intensive rehabilitation package in place, The case manager co-ordinated an intensive rehabilitation package after David’s injuries.
Physiotherapy, pain management and psychological support were all put in place and an electric wheelchair, adapted vehicle and adaptations to David’s son’s house were also paid for to enable David to visit his family.
The Defendant initially offered a lump sum of £1.25m in settlement, which was rejected. However as Mr Pullen's care regime had been put in place through interim payments, we were able to demonstrate that this was the level of care he actually required for the rest of his life. This led to the case eventually being settled before trial for the lump sum of £1.75 million, plus periodical payments of £305,000 per annum to fund Mr Pullen's care home and therapy fees. The periodical payment will also be updated in accordance with ASHE 3211 and 6115 so that all of David’s future case and case management needs are secured for the rest of his life.
Overall, the capitalised value of the award negotiated is in excess of £5 million.
