James' story - accident at work

Shana, WiltshireJames was working as a theatre porter in a hospital. He had been working at the hospital for a few years and his responsibilities included assisting the nursing staff moving patients from their beds to the trolleys and back again. On one occasion, he was assisting two nurses transfer a patient back into his bed. The two nurses were supporting one side of the patient whilst James supported the other. Unfortunately both nurses lost their grip of the patient who then rolled on top of James' right hand, trapping his middle finger and causing a crushing injury which required medical treatment and physiotherapy.
As a result of his work accident, James suffers from limited movement in his injured finger and, as he is right handed, the injury has affected his dexterity in many ways. James also had a pre-accident history of depression which became exacerbated by the accident. As his injury has prevented him from working this has led to him feeling frustrated, de-motivated and anxious.
James approached specialist accident at work solicitors, Alexander Harris. The firm are representing James in his claim for personal injuries and related financial losses including loss of earnings. James' claim is being brought on the basis that the two nurses James was assisting had very little training, if any, regarding the patient transfer procedure and this had essentially been the cause of the accident. With proper training the work accident could have been avoided. The hospital has accepted responsibility for the accident and the firm are negotiating a compensation settlement for James.
