Compensation for Former Female Sergeant after Military Accident
A former female Sergeant has been awarded £750,000 after she was accidently shot in the knee by a colleague.
Our client was left requiring emergency treatment whilst serving in Iraq in 2004 after she was accidently shot by a master sniper on a shooting range. She was later returned to the UK where she continues to undergo treatment for her injuries. Doctors at Selly Oak and Queen Elizabeth hospital have indicated that she will require total knee replacement within 10-15 years of the date of injury with replacements for life.
She was medically discharged from the army, ending a very promising career in which she contended that she would have applied for, and achieved either a Commission or extended service to age 55. There was little doubt that she would have achieved 22 years service in the military.
After approaching Irwin Mitchell to pursue a military injury claim, she was awarded the six figure sum in an out of court settlement. The award recognised the pain and suffering that our client has experienced as well as her ongoing treatment. The figure also took into account the difference between her anticipated earnings from her military service and her residual earning capacity in civilian employment.
The settlement allowed her the costs of undertaking surgery privately in the future and includes accommodation expenses from the date of her medical discharge to the date of her pre accident retirement from the army. It also includes compensation for past and ongoing care costs associated with her injury and disability, pension and lump sum terminal grant loss as a result of early retirement from the army.
