Group of 120 holidaymakers awarded £350,000 after illness on holiday

A group of 120 British holidaymakers have been awarded more than £350,000 in damages after becoming ill whilst on holiday at an all-inclusive resort in Cancun, Mexico.

Irwin Mitchell launched a group action claim against UK tour operator My Travel following an illness outbreak at the Viva Azteca Hotel in 2003 that left guests suffering from symptoms of diarrhoea, vomiting and stomach cramps. Many of those affected have been left with long term symptoms including Irritable Bowel and Chronic Fatigue Syndrome as a result of their illness.

Specialist holiday illness solicitors from Irwin Mitchell successfully negotiated the six-figure settlement for 120 affected guests, with the biggest payout to a single claimant totalling £26,619.

Mr and Mrs Rose from Ferryhill, County Durham were two guests who suffered an illness whilst staying at the hotel and, following a two-year legal battle for compensation, were successfully awarded around £7,000 compensation.

Paul Taylor and his wife, along with their two children, fell ill with diarrhoea just days after arriving at the Viva Azteca Hotel in Mexico. Their symptoms became so bad that the hotel doctors had to attend to them and Mr Taylor’s symptoms continued on his return to the UK. He was later diagnosed with Irritable Bowel Syndrome.

After approaching Irwin Mitchell to make a holiday illness claim, the family were awarded in excess of £10,000 in compensation.
