Holidaymaker wins compensation in successful Irritable Bowel Syndrome claim
Irwin Mitchell has successfully recovered £5,000 in compensation for a client who suffered from irritable bowel syndrome whilst on holiday with his family.
Travel illness solicitors at Irwin Mitchell recovered the four-figure sum for Mr Armstrong after he fell ill whilst on holiday with his wife and two children. Within just two days of arriving at the hotel, Mr Armstrong began to feel unwell as a result of irritable bowel syndrome. His symptoms consisted of diarrhoea and abdominal pain although he did not experience vomiting. Mr Armstrong’s illness became so severe that he later experienced weight loss and post illness lethargy.
Doctors at the resort provided Mr Armstrong with medication to ease his symptoms and advised him to change his diet to skinned chicken, boiled rice and vegetables for the duration of his holiday. His symptoms however continued to cause discomfort and even after returning to the UK, he had to get up several times during the night to use the toilet. He attended his GP and gave stool samples which were returned clear.
For several months after his return from holiday and the onset of his illness, Mr Armstrong found that certain foods would trigger bouts of diarrhoea, such as Indian or Mexican meals and spicy foods. It took approximately three years before Mr Armstrong made a full recovery from his illness.
Mr Armstrong approached Irwin Mitchell to make an irritable bowel syndrome claim, believing that poor hygiene standards in the hotel were responsible for his illness. Amongst his complaints, he reported seeing birds in the buffet area feeding from the display trays and fouling. He also made a formal complaint when at breakfast, four out of the six sealed packets of jam his family had chosen contained white mould.
Specialist solicitors from Irwin Mitchell were able to obtain holiday illness compensation amounting to £5,700.
